The Minority in Parliament has said President Kufuor has no powers to retain in office without Parliamentary approval minister-aspirants who have resigned.
Speaking to Joy News, the MP for Tamale Central, Alhaji Inusah Fuseini said it is unconstitutional for the ministers to still remain in office until the end of the upcoming African Union Summit in Accra.
He therefore called on the ministers to leave office immediately.
“The Constitution is very clear on it. Article 81 says that the minister’s office shall become vacant if he resigns. As soon as the deed was constituted the president had no power under the constitution to extend their stay in office,” he argued.
Alhaji Fuseini said constitutionally the President should have informed Parliament about extension of the ministers stay in office.
“Even if the President appoints an acting minister he has to inform Parliament. I have read the constitution and it states in clear mandatory terms that the minister’s office shall become vacant if the minister resigns. It does not even talk about acceptance from the President,” he told Joy News’ Israel Laryea.
Eight cabinet ministers aspiring to become NPP flagbearer in the 2008 elections resigned from office last week following a directive issued by President Kufuor that all minister-aspirants must resign.
After their resignation, the President gave them up to the end of the AU Summit to leave office to enable them perform their scheduled assignments.
