After three days, three nights in police and BNI custody and shuttled between the court room and cells, terrorist suspect and Member of Parliament for Assin North Kennedy Agyapong is free, at least for the time being.He was granted a ¢200,000 bail, Thursday afternoon, in a riveting court room drama which saw him bailed, rearrested and slapped with fresh charges.Kennedy Agyapong was held for comments he made on an Accra Radio station which were described as inflammatory.After a botched attempt by the prosecution to secure a two week remand at the Magistrate Court on Wednesday, lawyers for the beleaguered MP filed for bail at a Human Rights court on Thursday.That was after he had been held in custody for more than the mandatory 48 hours. The court granted him bail.Shortly after, he was rearrested with an amended charge of treason felony, attempted genocide and engaging in terrorist acts by the prosecutionLawyers for Agyapong had to contend with the new charge of terrorism in addition to the charges of attempted genocide, treason felony which were hanging around his neck.The lawyers argued that the facts of the case presented by the prosecution do not support the charges of terrorism, treason felony and attempted genocide filed against their client and appealed to the Judge to grant the MP to bail.One of the lawyers for the defence, Ayikoi Oto cited the Seidu Vrs Republic case in which the defence was granted bail because the facts presented by the prosecution do not support the charges filed against him.The Judge wondered why the prosecution did not charge the suspect with milder offences in Criminal Offences Code 207 and 208 which had charges as offensive conduct, breach of peace. Agyapong was thus granted bail and later released to hundreds of animated New Patriotic Party supporters who have besieged the High Court chanting.Through the principal streets and in a convoy, Agyapong was driven from the courts amidst chants by supporters to the NPP Party HQ in Accra where he addressed the teeming supporters.
