Well, well, well, what do we have here - On the Circle-Achimota road, a policeman is captured on a motorbike without a helmet. The ride may or may not be for commercial purposes.
Here is the problem: How do you force the law enforcer to enforce the law?
In 2012, Ghana got a law to legally arrest and prosecute people who used motorbikes known as 'okada' for commercial transportation purposes.
Law I: Legislative Instrument (LI) 2180 of 2012, Regulation 128 states, “ The prohibition of use of motorcycle or tricycle for commercial purpose.”
The verdict: We are not sure if the Police got a lift or paid for the ride. One privelidge drivers freely give the police is a free ride.
And since you and I were not there - we could let this pass - even grudgingly.
Law II
Regulation 128 compels riders to wear reflective jackets, helmets, knee and elbow caps and riding boots. The law is to ensure maximum safety for the motorbike riders.
The Verdict: Anyone can be the judge.
Herein lies the problem: Those who have power in Ghana often don't have the will and those who have the will, well - don't have the power.
