A commercial court in Accra has adjourned to next week Wednesday, ruling on an application challenging the capacity of Andrew Awuni to sue 13 other persons and institutions for their roles in the sale of merchant Bank.
Lawyer for Fortis, Tony Lithur last week filed an application in which he challenged the locus of Andrew Awuni to take the matter to court.
Mr. Awuni has sued 13 institutions and persons, including the Social Security and National Insurance Trust, Fortiz,the Bank of Ghana, KPMG and all board members of Merchant who were at the centre of the sale.
The boss of the Centre for Freedom and Accuracy is praying the court to stop the sale of the bank.
But even before the Commercial court will hear the merits of the case, Lawyer for Fortiz Tony Lithur filed an affidavits at the court challenging the capacity of Awuni to sue.
He said among other things that Awuni is not a contributor to SSNIT and cannot purport to sue on behalf of contributors.
The court adjourned the case today and heard the opening arguments between lawyers for Awuni and Tony Lithur.
It has adjourned to December 8 to give its judgement.
