A Court of Appeal in Cape Coast has dismissed an application filed by the MP for Assin North, James Gyakye Quayson.
Mr. Quayson was praying the court to refer the interpretation of Article 94(2a) of the 1992 Constitution that bothers on when the qualification of the MP kicks in, to the Supreme Court.
The Court has also refused an application seeking to file additional grounds of appeal by lawyers for the Assin North MP, Mr Gyakye Quayson.
Lawyers for the Assin North MP are appealing a judgment of a Cape Coast High Court that restrains Mr. Gyakye Quayson from holding himself as the MP for the people of Assin North.
The embattled MP has been fighting a dual citizenship case after he won the Parliamentary seat in the 2020 elections.
The plaintiff is challenging the eligibility of Mr Gyakye Quayson to contest the 2020 elections based on the provisions of Article 94 (2) which spells out the qualifications of an MP.
Meanwhile, the Court has set 24th January, 2022 to determine the stay of execution filed by lawyers for Joe Gyaakye Quayson.
