The Ghana Bar Association has issued a stern warning to its members to desist from commenting on cases in the media in which they serve as counsel.
In a statement the GBA said the practice goes against its ethics and amounts to misconduct.
One of its members Chris Ackumey agrees. He tells Joy News once members agree to the decision taken by the Bar Council, it should be adhered to.
“It is a time tested expectation that when there is a matter pending before the court, lawyers in the matter should not comment on it. I think it is appropriate,” he said.
He however finds it difficult to understand why another lawyer who has no interest in a case cannot make his educated opinion known on a case that has been dealt with by the court.
He noted that the legal profession like society must be dynamic, saying lawyers and judges must not be afraid to make comments on a decided case or one pending before them.
Not all lawyers share the position taken by the Bar Council.
Mr. Amuzu who is also the Executive Director of the Legal Resources Centre said the position by the GBA cannot stand any test of scrutiny.
He said a judge whose verdict is influenced by comments in the public is not worth to be part of the Bench.
He said it completely wrong for lawyers to be prevented from making comments on a case which is of public interest.
Mr. Amuzu said there are other important issues like student’s lack of access to the Bar and that should be of concern to the GBA.
