A Cape Coast High Court has ordered the eviction of Prophet Miritaiah Jonah Jehu-Appiah, the defrocked Akaboha III of the Mozama Disco Christo Church (MDCC) from his official residence at Gomoa Mozano in the Central Region.
The order followed a suit filed by the Plaintiff, Akaboha III on December 12, 2010, asking the court to allow him to occupy the residence.
On 20 December, 2010, the court presided over by Justice J.K. Dorgu ordered that the writ of possession should be issued to the Defendants/Applicants accordingly to enable the church take possession of the duty post.
"It is hereby ordered that the application for the order for writ of possession in execution of the final Judgment herein be and hereby granted as prayed," the court ruled.
Akaboha is a title given to the General Head Prophet and Leader of the MDCC.
In another development the court on 27 January dismissed the stay of execution filed by the former Akaboha III to set aside the Judgment ruled against him.
The Court said the writ of possession was granted by the court on December 20, 2010 the very day the application was filed.
"I do not see any compelling new issue that will warrant me vacating the order I had already made on the said 20 December, 2010", Justice Dorgu said.
The Court explained that if the Plaintiff/Applicant admitted that he was no longer the Akaboha, then the issue of whoever occupied the official residence was at the discretion of the church.
The Judge said: “I will on that basis refuse the application as hereby do and dismiss same as unmeritorious."
The court subsequently awarded a cost of GH¢500 Ghana against the Plaintiff/Application.
