The prosecutor who began what has now become the controversial cocaine swap saga has rejected claims the police is to blame for the delay in prosecuting the case.
DSP Idan Dery told the public hearing constituted by the Chief Justice to investigate the circumstances under which the cocaine was swapped with washing soda that missing dockets were to blame for the delay.
The Circuit Court Judge Eric Kyei Baffuor testified on Monday that he personally resurrected the case after almost one year in abeyance.
He argued neither the police, nor the state attorney had shown interest in seeing to the logical conclusion of the matter. He said but for his interest and intervention, the dockets would still be gathering dust on the shelves of the Circuit Court. But DSP Idan Dery disagreed.
Joy News Editor Samson Lardy Ayenini who was present at the hearing reported the prosecutor as saying that the file in which the documents, relating to the case, were put into could not be found.
According to DSP Dery he began prosecuting the case until he had to travel to Sudan in 2009. He said on his return in March 2010 he made several efforts to get the dockets to continue from where he left off but the court clerk told him he could not locate the dockets for the case and pleaded for more time in order for the dockets to be reproduced.
He said under the circumstances the police cannot be accused of stalling the process.
State Attorney Stella Arhin had last week told the committee that they had to prepare a new charge sheet before proceeding with prosecution.
The panel, Lardy Ayenini reported, has completed its hearing but will sit to analyse the various submissions and present its findings to the Chief Justice
