The Appeals Court has dismissed a suit filed against Opanyin Abraham Adusei, Spiritual Leader and Head of the Saviour Church, seeking to restrain him from operating with the name of the church.
The suit, filed by Mr. Asante Asirifi and two others, had prayed the court to hold back Opanyin Adusei who is also the General Superintendent of the Church at Osiem in the Eastern Region, and four others, from using the name of the Church to do any spiritual or religious activity.
The plaintiff claimed in the writ that, the Church was incorporated in 2007 as a limited liability company at the Registrar General's Department and that it is only the plaintiff Mr. Asante Asirifi and his group who have the legal mandate to operate the church.
The plaintiff further accused the defendant of using the name of the church wrongfully without having that mandate.
The Court, presided over by Justice Gertrude Torkornoo after thoroughly studying the appellant's writ, dismissed the application and maintained the earlier ruling by the High Court.
The judges explained that, the Church was established in 1924 with its General Headquarters at Osiem where Opanyin Adusei currently operates from, as was proven by the defendant at the High Court.
The Court also maintained the earlier ruling by the High Court and said the plaintiff’s application was premature.
The Court therefore dismissed the application and awarded a cost of GH¢10, 000 against the appellant, Mr. Asante Asirifi and two others.
