The Member of Parliament Bawku Central, Adamu Dramani has won a major victory at the Court of Appeal in the case in which his eligibility to hold the seat is being challenged.
The Court, by a unanimous decision, ruled that the plaintiff in the case, Sumaila Bielbil, should have filed an electoral petition and not a writ of summons.
A member of Mr Dramani’s legal team, Egbert Faibille told Joy News after the ruling that there was no case against the Bawku Central MP in the wake of the Court’s decision.
He said the ruling also meant that Sumaila Bielbil’s case had collapsed irretrievably since the very foundation on which the case was rooted had been declared unmeritorious by the court and therefore set aside.
Lawyer for Mr Bielbil, Dr Raymond Atugubah said his client has instructed him to appeal the decision at the Supreme Court.
He told Joy News’ Dzifa Bampoe that by Monday next week he will commence the necessary processes to have the decision reversed.
The country's electoral laws allow for a period of 21 days after the gazetting of elections results, to file petitions. Beyond this period an aggrieved person must have lost the opportunity to petition against any election results.
