The flagbearer of the People’s National Convention (PNC), Bernard Anbataayela Mornah, has filed a lawsuit against the Electoral Commission (EC) following his disqualification from the upcoming December presidential election.
Mr Mornah was among 11 presidential aspirants disqualified from contesting in the December 7, 2024, elections.
According to the EC, the disqualification was due to the aspirants’ failure to correct errors on their nomination forms.
EC Chairperson, Jean Mensa, stated that Mornah’s nomination forms had incomplete supporter details and that he used registered voters from one district to support nominations in other districts, which violated the electoral rules.
However, Mr Mornah contends that his disqualification was unlawful, violated his rights, and did not follow due legal process.
As a result, he is seeking a court order to compel the EC to reinstate him as a presidential candidate in the 2024 elections.
He seeks an order of mandamus compelling the 2nd respondent (the Returning Officer, in this case the Chairperson) to declare him as duly nominated to contest the 2024 presidential elections.
Again he seeks an order restraining the EC and the Returning Officer from printing the presidential ballot papers or carrying on with the December 7, 2024 Presidential Elections until he is declared duly nominated candidate of the PNC and allowed to contest the elections.
