Executives of the New Patriotic Party (NPP) branch in the Biakoye Constituency of the Volta Region have been ordered by a Hohoe High Court presided over by Justice M. H. Logoh to refrain from holding themselves forth as executives of the party.
The court has therefore ordered the NPP Regional Executive Committee of the Volta Region to put together a seven-man interim executive to run the affairs of the party in the Biakoye Constituency.
The High Court handed down the ruling on November 1, 2007.
The court gave the order after the plaintiff in the matter, Christian Dzilla of Kwamekrom filed, on July 24, 2007, a motion praying for an order of interlocutory injunction against the defendants (constituency executives) to prevent them from holding themselves forth as the Biakoye Constituency executives of the New Patriotic Party.
Other plaintiffs included Asare Kingsley, Abdul Tanko Issah and Waiter Kwame Yeboah, all of Worawora, and Emmanuel Botwe of Tapa Amanfrom.
In their statement of claim, the plaintiffs stated that, the defendants and some others engaged themselves in an unlawful constituency officers' election held on February 9, 2007.
They further pointed out that during the said election, the defendants were purportedly elected and have variously and collectively been holding themselves forth as the constituency executives of the constituency to the chagrin and annoyance of the plaintiffs.
The plaintiffs further pointed out that they are bona fide members of the Biakoye Constituency of the NPP, and “have an interest in whoever represents the said constituency and bring this action for themselves and other like-minded members”.
The plaintiffs averred further that, prior to the conduct of that illegal election, the defendants and some others had instituted an action against them (plaintiffs) in a Circuit Court at Kpando.
They contended that, the application for directions in that case were taken, and the case was ripe for hearing, but they (the so-called executives) persistently absented themselves from court until the case was adjourned sine die.
The plaintiffs further argued that before that adjournment, the Kpando court placed an injunction on the conduct of any election in the Biakoye Constituency until the final determination of the issues involved.
In spite of the court injunction forbidding the holding of any elections whatsoever, the National Organiser of the Party, Lord Commey, in the absence of the Regional Chairman and other stakeholders purportedly organised an election and appointed new officers (the defendants in the new case.)
