A criminal court in Accra has adjourned the trial of Assin North MP, James Gyakye Quayson to the 6th of July.
This was after the Speaker of Parliament served notice to the court that the accused is on a national assignment – thus his swearing into office as MP and would be unavailable for the trial.
Although Mr Gyakye Quayson's lawyers were supposed to file a motion for a stay of execution so that arguments could be heard today [Tuesday], the lawyers for the state and the accused agreed to adjourn the trial so that Mr. Quayson could be sworn in.
Commenting on the issue after the proceedings, the Head of Legal Affairs of the National Democratic Congress, Abraham Amaliba, said the adjournment was necessary because one person cannot be at two places at the same hence the letter of notice.
“So today, the court agreed to adjourn the matter to the 6th July 10.00 am when Quayson himself is here,” he said.
He added that the legal team is not afraid of the criminal trial, adding that they intend to put in a strong case for their client, adding that, “what we don’t want is for the state to use its might to rail the process so that our client will go to jail.”
“We want the processes to be fair,” he added.
He also supported the Dormahene's call on the Attorney General to enter a nolle prosequi to end the trial.
“I think that the Attorney General does not understand his role. His role as an Attorney General is to prosecute on behalf of the republic and the people of this country are the custodians of the Sovereignty. so if a Ghanaian feels that it is a complete waste of time to continue prosecuting the MP-elect and voices out that, the Attorney General should use his power of nolle, I don’t see anything wrong with that" he noted.
