The Programmes Officer at the Centre for Democratic Development (CDD), Mr Paul Kwabena Abrampah has advised Parliament to wait for an official documentation from the Electoral Commission (EC) on the candidature of the three independent Members of Parliament who have crossed carpet to the New Patriotic Party (NPP) before deciding their fate.Three independent MPs, Mr Joseph Osei-Owusu of the Bekwai Constituency, Nana Yaw Ofori-Kuragu of Bosome-Freho and Seth Adjei Baah of Nkawkaw, all won their seats as independent candidates in the 2008 elections but when they decided to run for the NPP primaries, Nana Yaw Ofori-Kuragu and Seth Adjei Baah lost their bids with only Mr Joseph Osei-Owusu winning.There have been calls that in accordance with Article 97(1)(h) of the 1992 constitution which states: “A member of Parliament shall vacate his seat in Parliament if he was elected a Member of Parliament as an independent candidate and joins a political party,” the three MPs should vacate their seats.Mr Ofori-Kuragu, MP for Bosumi Freho told Joy News’ Evans Mensah that he knows what the law says on the matter but will not vacate his seat unless the Speaker of Parliament says so.Programmes Officer of the Centre for Democratic Development, Mr Paul Kwabena Abrampah speaking on the matter on Election Headquarters on Joy FM Tuesday said it was an interesting development and Ghanaians will need the interpretation of the law to get a clearer picture of the situation.He was of the view that, “if indeed Parliament wants to follow this up, the first thing Parliament should do is to ask for a form or any declaration from the Electoral Commission (EC) whether indeed if this said person has changed his documentation with the Electoral Commission to join a different party.”Another method, he said, will be to wait for the EC to open nominations for candidates to see in “which name does the fellow file, is it in his original capacity as an independent candidate or through a [political party] and then he can be asked to vacate his post.”But without an official documentation, Kwabena Abrampah stressed, “We might say we might have a point but it is very difficult for us to prove.”He said, in the Ghanaian dispensation, more things do happen and it is essential that good interpretation from the judiciary and other bodies are given to help resolve them.
