Klottey Korle MP, Nii Armah Ashitey, has been left to fight alone in his effort to remove Dr. Zanetor Rawlings as the NDC's parliamentary candidate for the constituency.
Mr. Ashitey and another member of the governing National Democratic Congress (NDC), John Nii Alphonse Coleman jointly brought a suit against Dr. Zanetor who beat the MP in parliamentary primary last year.
They contend she was not qualified to contest the election because she was not a registered voter - pre-requisite for all candidates vying to win the NDC's parliamentary slots.
But when the case was called Friday, to the surprise of Mr. Ashitey and his lawyer, his partner in the case declared his intention to withdraw from the case.
Mr Coleman filed a case through another lawyer to have the court strike out his name as party to the suit.
The High Court hearing the case consequently struck out his name Friday, March 11, 2016, leaving Nii Armah Ashitey to fight his case alone.
Gary Nimako, who was lawyer for the two, opposed the move insisting it violated the court’s rules because he was not informed by his client about a decision to withdraw from the case.
But the Court disagreed with him and struck out Mr. Coleman as an interested party in the case.
It also struck out the EC as a third respondent in the case following the release of a letter which indicates Dr Zanetor is not a registered voter.
Nii Armah Ashitey and Nii John Coleman, both aspirants in the National Democratic Congress (NDC) constituency primary filed a suit against the winner, Dr. Zanetor Rawlings claiming she is not a registered voter and therefore not qualified to be elected as a parliamentary candidate.
Other parties joined to the suit were the NDC and the Electoral Commission (EC) but the EC has now been struck out.
The case has been adjourned to March 18.
