The upcoming National Delegates Congress of the People National Convention (PNC), slated for 9-11 December, 2011, is in danger following the tiling of a motion at the Accra High Court by five members of the party seeking an order to restrain the party from organising the event in Sunyani.
The five are Ibrahim Karim, Haruna Abass, Abubakari Sadick Wiyor, Benard Bama-Ame and Michael Anafo.
The applicants are also seeking an order to restrain the PNC, Dr Edward Mahama, Alhaji Ahmed Ramadan and Benard Momah from introducing themselves as Leader, Chairman and General Secretary of the party or to grant interviews to the media or participate in any media or public programme in their purported capacities as such.
They are further seeking an order to restrain the respondents from withdrawing or spending any funds from the accounts of the PNC or soliciting any funds from any person or organisation from the benefit or on behalf of other party.
The Electoral Commission (EC) has also been joined in the suit and applicants are further seeking an order to restrain the EC and other respondents from conducting or supervising any constituency, regional and national delegates’ congress of the party for the reason that the mandate of the respondents, apart from the EC, had expired since November 30, 2011.
Consequently, the Accra High Court had fixed December 14, 2011, to hear the various arguments of the counsel for the parties.
Meanwhile, the EC had also filed a motion seeking to strike out its name from the suit as a respondent.
At the court's sitting in Accra last Monday, counsel for the applicants, Dr Sontim Tobiga, said certain discrepancies in the affidavit in support of the motion compelled the applicants to file a supplementary affidavit in support of the motion for interlocutory injunction which had not been served on the respondents.
Mr James Agalga, counsel for the respondents, except the EC, said the respondents were yet to receive the supplementary affidavit in support but they had already filed their affidavit in opposition.
He said the date for the hearing of the motion would inconvenience the respondents because they would be unable to hold their national delegates congress, on which they had invested resources.
The EC is being represented by Mr James Quarshie-Idun.
In an affidavit deposed to by Benard Bama Ame on behalf of the other applicants, the applicants accused their party executive of embezzling the party's funds by withdrawing funds belonging to the party without regard to or in violation of laid-down procedures and for their personal benefit, among other malpractices.
