Mr. Ayikoi Otoo, lawyer for New Patriotic Party chairman, Jake Obetsebi-Lamptey says his client will advice himself over government’s decision to repossess a government bungalow sold to him by the Kufuor administration.
A statement signed by the Information Minister, Fritz Baffour said the decision by Cabinet not to hand over the property to Mr. Obetsebi Lamptey was taken in the ‘supreme interest of the people of Ghana’.
But Ayikoi Otoo told Joy FM that the decision by the government is a ‘regrettable decision’ and amounts to rolling back the gains the country has made under its present constitutional dispensation. See Government Statement here.
The Supreme Court in a 6:3 majority verdict Tuesday dismissed a suit by two deputy ministers challenging Jake's acquisition of the property situated at No. 2 Mungo Street, Ridge.
Ayikoi Otoo who was speaking in an interview with Joy FM, said per the constitution, neither the president nor parliament has power to oppose decisions of the judiciary in whom judiciary power is vested.
According to the former Attorney General, the President swore to uphold the constitution and that Cabinet's decision on the matter amounts to arrogating the final judiciary authority to the Executive arm of government.
Ayikoi Otoo stated that the President and his Cabinet are treading on very ‘dangerous grounds’, adding that neither the president nor the vice president is above the law and their failure to obey the ruling of the Supreme Court can constitute grounds for their removal from office.
Asked what action next avails his client, Ayikoi Otoo said they will ‘advise themselves’.
