Rejoinder: CPP Veep in trouble

We are solicitors for Nana Akusua Frimpomaa Sarpong Kumankuma and have her instructions to reply on her behalf to a story carried under the caption “CPP Veep In Trouble” on page 3 of the Wednesday, November 13 2013 edition of your “Daily Guide” newspaper.

The story complained about was written and published in your newspaper without any enquiry having been made from our client to afford her state her version of events in accordance with the best standards of journalistic practice.  As a result of this infraction, the story carried and complained about is false and factually inaccurate, grossly misleading and totally misrepresentative of the currently-pending civil litigation involving herself and Liberty Capital Ghana Limited at the Commercial Division of the High Court of Justice, Accra.

By virtue of the above, our client hereby wishes to exercise her right to a rejoinder by requesting for the publication of this statement in your next edition with equal prominence and attention given to all its terms:

1    Our client is the representative in Court of a private limited liability company known as “Human Potential College Limited” which is involved in a suit that was brought before the Commercial Division of the High Court of Justice, Accra on 20th December 2012, and which is entitled: Liberty Capital Ghana Limited –v- Human Potential College Limited (Suit No. RPC/433/12).  IT IS THEREFORE TOTALLY FALSE AND MISLEADING TO REPORT AS YOU DO IN YOUR STORY THAT “NANA AKOSUA FRIMPOMAA HAS BEEN HAULED TO COURT”, AS YOU HAVE DONE IN YOUR EMBOLDENED FIRST PARAGRAPH OF THE ARTICLE PUBLISHED.  YOUR REFERENCES TO OUR CLIENT AS “THE ACCUSED” PERSON IN THE AFORESAID ACTION IS EQUALLY MISLEADING AND MISCHIEVOUSLY PEJORATIVE IN THE SENSE IT CONVEYS THAT NANA AKOSUA FRIMPOMAA SARPONG IS SOMEHOW A PERSON CHARGED AND FACING CRIMINAL PROSECUTION IN CRIMINAL PROCEEDINGS.

2    Aside from its defence to the aforesaid court action, Human Potential College Limited also maintains a counterclaim against the Plaintiff, Liberty Capital Ghana Limited, and is seeking an order from the Court for the payment of heavy damages for monetary losses caused by the unlawful breach of contract by that company.  YOUR REPORT IS THEREFORE ALSO FALSE AND MISLEADING IN THE MANNER THAT IT SEEKS TO PORTRAY THE CIVIL SUIT PURPORTEDLY REPORTED ON AS SOME ONE-SIDED COURT ACTION THAT HAS BEEN BY THE PLAINTIFF FOR THE RECOVERY OF MONEY TAKEN FROM IT BY OUR CLIENT BY FALSE PRETENCES.

3    Nowhere in its lawsuit that is currently before the court has the Plaintiff ever claimed that either Human Potential College Limited, or our client has ever forged any documents in order to secure financial assistance.  The documents in respect of the land in question were and always have been in the name of the Seller of the land, who happened to offer it up for purchase to Human Potential College Limited.  The true facts of the matter are that it was later found out that the Sellers’ own legal title to the land was under legal contention in a separate and hitherto unknown court case, which thereby rendered the land unsuitable for use as collateral for a cash advance.  IN THE FACE OF THESE FACTS, THE NEWSPAPER ARTICLE REPORT STANDS AS TOTALLY FALSE AND MISLEADING, AND THE REPORT IN THE ARTICLE ON THE TESTIMONY OF RICHARD PREMPEH IS EQUALLY SO.

Our Client wishes to assure all members of the public that she has and will continue to hold firmly on to the hallowed virtues of honestly, integrity, and sacrifice to her country as she is reputed to do.
