The Supreme Court has once again adjourned the hearing of the case brought before it by Ransford France, a business man challenging the authority of the Electoral Commission to create 45 new constituencies in the country to October 15.
The Supreme Court earlier dismissed an interim injunction filed by Joe Ghartey, the lawyer for the plaintiff, to prevent Parliament from considering the Constitutional Instrument (CI) 78.
Conspicuously absent in court today was the attorney general Benjamin Kumbuor, but he was represented by principal state attorney Sylvester Williams. Counsel for the plaintiff Joe Ghartey told the panel of supreme judges that he had some disagreements with the application filed by the attorney general and needed some time to study the document in order to file a response.
Counsel for the plaintiff, Joe Ghartey during the last court hearing amended the writ of summons filed earlier in court to make the plaintiff’s case relevant and substantive.
The new application filed on Wednesday October 2 sought to make the creation of the 45 new constituencies unconstitutional. The AG’s department had until Tuesday October 9 to respond to the new application when the issue first came up in court and they did accordingly.
Justice Dr. William Atuguba granted counsel for the plaintiff’s request and adjourned the case to Monday October 15.
