The Supreme Court on Wednesday ordered that the court's processes be served on the Country Director of the International Finance Corporation (IFC), inviting him to testify in the case in which Tsastu Tsikata, former boss of the Ghana National Petroleum Corporation, is being tried by an Accra Fast Track Court, for willfully causing financial loss to the State. The court ordered that after being served with the processes, the Country Director had 21 days within which to file a response as to whether he will appear or not. The unanimous decision of the five-member panel chaired by Mr Justice William Atuguba, followed a motion brought before it by Tsatsu, praying the court to invite the Country Director to produce documents at his trial before the Fast Track Court. The other panel members were Mr Justice Steve Brobbey, Mr Justice Julius Ansah, Mr Justice R.T. Aninakwah and Mrs Justice Sophia Adinyira. Tsatsu brought the application following a Court of Appeal's decision reached on December 19, 2006 stating that the Country Director enjoyed immunity against giving evidence in the case. As a result of Tsatsu's application before the Supreme Court, the Fast Track Court, on October 31, had to adjourn the matter to December 6, to enable the Supreme Court to decide on the application. The Fast Track Court will now have to wait for the Country Director to give evidence before fixing a date for judgment. Tsatsu, who is being defended by Dr. Emmanuel Victor Oware Dankwa, has pleaded not guilty to the charges preferred against him. He is on a self-recognisance bail.Source: GNA
