Three people file contempt charge against IGP

The Asantehene’s Baamu Gyasehene, Nana Kwaku Nsia of Adankwame and two others have filed a motion at the Human Rights Court in Accra to commit the Inspector-General of Police and the Ashanti Regional Police Commander for contempt. The applicants contend that failure of the respondents to arrest 10 suspected criminals at Adankwame and Atwima Techiman in the Ashanti Region to be sent to Accra for investigation was a gross disobedience of an order of a court of competent jurisdiction. The two other applicants are Amadu Issifu and Amma Dabre, both of Adankwame in the Atwima Nwabiagya District of the Ashanti Region. In an affidavit in support of the motion, the applicants said they filed an application for judicial review in the nature of mandamus on January 26, 2011 for a court order for the arrest of the 10 suspected criminals. The suspects include Lansford Owuo, Kwasi Gabriel, Koo Emma, Papa Yaw, Kwadwo Owusu, Kwabena Agyei, Majeed, Kwabena Nkrumah, Agya Osei, all of Adankwame and the ex-Atwima Techiman Chief, Nana Sarfo. According to the affidavit, the 10 people, in various ways, committed very horrendous criminal acts against the applicants’ properties, for which reports were made to the Adankwame Police, where various extracts on each and every allegation of criminal acts were sent to the Suame Divisional Police Headquarters in Kumasi. It said besides the Police extract, applicants also exhibited various pictures evidencing the demolition of their house at Adankwame without any lawful basis, adding, “These people again have stolen various items, evidence of which we abundantly established before the court.” The affidavit said refusal of the Ashanti Regional Police Commander, Patrick Timbilla, to permit the arrest of the 10, especially Lansford Owuo and his marauding macho men, was established before the court. It said the court, after careful examination of the affidavit, accompanying the application together with the plethora exhibits, granted the application for the arrest of the named people. According to the affidavit, the registrar of the court prepared the order, which was duly served on the respondents as service proved. It said in April 2011, counsel for the applicants wrote to the two respondents of the need to obey the court order, especially when one of the persons to arrested, Koo Emma, had hacked a family member of the applicants called Kofi Nyamekye with a machete.
