The High Court in Accra has dismissed a motion brought by lawyers for the National Democratic Congress (NDC)’s parliamentary candidate for Korle Klottey, Dr. Zanetor Rawlings.
Lawyers for the Parliamentary candidate wanted a case challenging her election to be dismissed.
The case was filed by the incumbent Member of Parliament for Klottey Korle, Nii Armah Ashitey, who lost to Dr. Rawlings, daughter of the founder of the NDC, Flt. Jerry John Rawlings, in the party's primaries last year.
Her lawyers wanted the case dismissed because it lacked merit.
But the court disagreed.
It held that the lawyers did not wait to listen to Mr. Ashitey’s arguments before bringing the motion, Joy News' Kwakye Afreh-Nuamah reported.
The judge also pointed out that there were procedural errors and that the motion was not properly brought.
After the ruling, Dr. Zanetor Rawlings said she was neither daunted by the court's decision nor distracted by the case itself.
She told Afreh-Nuamah she was fully focused on her campaign.
The plaintiff in the case, Mr Ashitey said suggestions he is a bad loser are misplaced.
He said his interest in the matter is only to ensure the right thing is done.
Mr. Ashitey is arguing that Zanetor Rawlings was not a registered voter at the time she contested and won the elections and was therefore not qualified by the NDC's own rules to contest.
An earlier case brought against her was dismissed because the persons who brought the case lacked locus.
Mr. Armah Ashitey is hoping to get the court to declare Zanetor's election null and void.
