Lawyers for Mr. Napoleon Kpoh, the beleaguered General Secretary of the Industrial and Commercial Workers’ Union (ICU) say he will continue in office until an appeal he has filed against an adverse ruling has been heard.An Accra Fast Track High Court on Monday morning threw out Kpoh's suit against the National Executive Council (NEC) of the ICU, which removed him from office earlier this month, and ordered him to leave office within three days.However his lawyers told Joy News they were not satisfied with the decision of the Fast Track High Court and have therefore filed a stay of execution on his behalf, pending the determination of the appeal case and until then, he would remain in office.Mr. Kpoh contested his removal from office and dragged the NEC to court seeking a declaration that their action was illegal.But the Fast Track High Court, presided over by Justice Ofori-Atta ruled against Mr. Kpoh saying his term of office expired on August 10 this year.The court ordered him to hand-over the official vehicle of the union within three days.Mr. Kpoh and the former chairman of the Union, A.Y.B. Salifu were asked to pay an amount of GH¢200 each in cost to executives of the Union.Mr. Kpoh's lawyers, Cristoph Coker and Eric Atieku had argued that he can only hand over to new executives at an annual delegates congress yet to be scheduled.They argued therefore that Kpoh's removal is unconstitutional, and therefore the Interim Management Committee set up by the Council must not be allowed to function.But the NEC's lawyer Albert Adare countered that the constitution of the ICU will be undermined if Mr. Kpoh's injunction is granted.Mr. Albert Adare told Joy News that a formal application will be made to the court for Mr. Kpoh to hand over all property belonging to the union.
