The latest legal defeat in the case of Ghana@50 where two officials of the erstwhile New Patriotic Party (NPP) administration were freed by the court has incensed National Democratic Congress (NDC) activists who are calling on President Atta Mills, who is cooling off in the United States, to reconsider the appointment of Attorney General and Minister of Justice Betty Mould-Iddrisu. The NDC apparatchiks say the series of legal defeats in the courts must be looked at in order to save the party from further embarrassment. The court's ruling, which discharged Dr. Charles Wereko-Brobby, former Chief Executive Officer of the defunct Ghana@50 Secretariat that supervised the country's 50th Independence anniversary celebration, and Kwadwo Okyere Mpiani, Chairman of the anniversary's planning committee has caused commotion in the NDC. Betty Mould-Iddrisu was in Namibia for a conference during Tuesday's ruling. She was allegedly supposed to dash to Soccer City in South Africa to watch Ghana's match with that country. Dr. Wereko-Brobby and Mr. Mpiani were facing four counts of willfully causing financial loss to the state but pleaded not guilty and were admitted to GH¢35 million self recognizance bail each. John Jinapor, spokesperson for Vice President John Mahama, said he (Jinapor) was frustrated at the Attorney General's performance, saying it was time the A-G's office was scrutinised to ascertain the real cause of the many losses of cases in court. This, according to him, was bringing embarrassment to the government and causing apathy in party foot-soldiers. John Jinapor, who was speaking on Metro TV's Good Morning Ghana programme yesterday, said it was inexcusable 10 cite procedural errors for the defeats, "If you are not sure of winning a case, you do not go to court," he stressed. The court, presided over by Justice Samuel Marful-Sau, a Court of Appeal judge sitting with additional responsibility as a High Court judge, held that the Attorney General's attempt to prosecute the two NPP men "would lead to judicial absurdity." Justice Marful-Sau described the Attorney General's action as "unconstitutional" and said the action was an "abuse of the AG's powers under Article 88 of the 1992 Constitution." The judge said the essence of a Commission of Enquiry was to afford the President the opportunity to establish an independent body to investigate any wrongdoing and make adverse findings. Once the President went ahead to issue a White Paper, the findings became a judgment of a High Court. "If the intention is to prosecute public officials then the way to go is not to use findings of a Commission of Enquiry," the presiding Judge said. But Jinapor said that the A-G and her staff were giving the NPP ammunition to use against the incumbent government, adding "the truth is that some of our boys are not happy, and they have every justification to be unhappy" Mrs. Betty Mould-Iddrisu has vowed to take the two gentlemen back into the dock by appealing against the High Court's ruling, but lawyers of the freed met} said they were more than ready to meet her at the Court of Appeal. In the opinion of Mr. Mpiani, he has reasons to believe that his trial was more "political than legal." Speaking to Citi Fm yesterday, he was excited that the hustle of going to the court on a weekly basis had ended. "Honestly, I believe it was more political than something legal. I had a look at the issues and read the report and I was wondering where the loss was; and reading through the report, there was nothing pointing to me personally. "But we live in a society where people believe that others must be sacrificed because immediately, there was changeover, people were calling for prosecutions and the party foot-soldiers were pushing the ACJ to prosecute us so they even failed to look into the issues, that's my belief." He said he was not surprised at the ruling because he was convinced that he had not committed any error for him to be dragged to the court. "I always believe that the kind God will look at it and come out to let Ghanaians know that I haven't done anything wrong. I also believe in the judiciary that at least there are some judges there who will look at it arid listen to my lawyers and come out to say what I believe will be in my benefit. And when I came out I was very much relieved and I was thankful to God. The whole thing was let's try and get these people by fair or foul means instead of finding out what exactly happened," he said. Dr Wereko-Brobby accused Betty of political witch-hunting, adding that he was unperturbed by the AG's determination to use all means to prosecute him. "I feel very sad for the Attorney General because first of all, you are not in the country. Secondly, as a responsible Chief Legal Advisor to the government, I would have thought that the best thing to downs to study the judgment and then take a view to advise the government. "If she says by all means she will find a way to prosecute us then clearly we are in the realm of political vendetta: and as for political vendetta we will deal with and cross the bridge when we get there. What we should all understand is that, it is not the Attorney General who will decide whether Wereko-Brobby and Kwadwo Mpiani arc guilty of any offence. Whatever route she decides to go would have to be heard in a Court of competent jurisdiction and that's where these matters will be determined." "I have known Betty for over forty-live years and it's a sad day that she did not take her time and come back to Ghana. She started off her interview by saying that she had not studied the judgment and needed to do that, but unfortunately she went on to make highly contentious political points which really were totally uncalled for. But it's her prerogative to appeal and to look for other charges if she wants to pursue her political vendetta, and we are ready to deal with those matters." he stated. Source: Daily Guide
