The Fair Wages and Salaries Commission (FWSC) has charged the National Labour Commission (NLC) to take legal action against members of the Federation of University Senior Staff Association (FUSSAG) for embarking on what they describe as an illegal strike.
The Commission says members of the FUSSAG have not basis at all to strike.
The federation announced an indefinite nationwide strike at all public universities on Monday, saying its members will only return to work after concerns relating to their migration onto the Single Spine Pay Policy (SSPP) are addressed.
But the Director of Negotiation and Grievances at the FWSC Cornelius Yawson questioned; "Why would you [FUSSAG] go on strike over interim market premium when a whitepaper has come out that it has seized. Or indeed...strike over base pay which is not at all under your purview."
The Commission has also rejected demands for a restart of the stalled negotiations over the base pay and other conditions of service of the FUSSAG members.
According to Cornelius Yawson, "once the matter becomes a strike, it is no more under the purview of the [Commission]".
He noted that as the situation stands now, the NLC is the appropriate institution to deal with the matter.
"They [NLC] have that power to say a strike is legal or illegal and indeed to bring striking unions or associations to book", he noted.
