An Accra Fast track High Court has described unlawful the dissolution of the Board of the Bank of Ghana by the late President John Mills in 2009.
Samuel Okudzeto who was then the Board Chair at the Bank, filed a suit against the president challenging the legality of the action taken.
He sought from the court to declare as illegal, void and of no effect the dissolution of the Board when their term of office was yet to expire.
He also asked the court to set aside the purported appointment of the new members to the board of the Bank of Ghana.
After three years the court, presided over by Justice KN Aduama Osei upheld the arguments raised by the plaintiff.
In his ruling the judge said the president or the appointing authority cannot remove a public official without following due procedures.
He said, like of the Bank of Ghana case, where it is clearly stated under what condition a public official “shall cease to hold office,” it does not lie in the power of the president to by edict or directive cause the removal of the public official.
The judge however faulted the Kufuor administration for making the renewal of tenure of office of the Bank of Ghana board ahead of time.
Sam Okudzeto was appointed to the Board in 2001 but his tenure was renewed to 2007.
