Information available to Myjoyonline.com indicates a citizen is heading to court to annul the results of the NDC’s Klottey Korle parliamentary primary.
The first daughter of the founder of the governing National Democratic Congress (NDC), Jerry John Rawlings, won the Klottey Korle primary held last Saturday.
Dr. Zanetor Agyeman Rawlings beat incumbent MP, Nii Armah Ashitey, by polling 2,403 votes, representing 62.22 percent of the total valid votes cast.
Nii Armah Ashitey polled 1,348 votes.
But even before Dr. Rawlings savours her victory after a long-drawn-out election characterized by accusations and counter-accusations, others are considering challenging her eligibility to contest the elections in court.
In the next few weeks, this case is expected to be filed in court.
As part of the NDC’s eligibility criteria, the party states, among other things that a party “member shall not be qualified to contest primaries to go to parliament if he [or she] is disqualified under the national electoral laws from contesting for a parliamentary seat.”
Also, article 94 of Ghana’s Constitution states that “Subject to the provisions of this article, a person shall not be qualified to be a Member of Parliament unless (a) he is a citizen of Ghana, has attained the age of twenty-one years and is a registered voter.”
It has been suggested that Dr. Rawlings is not a registered voter in the Klottey Korle Constituency.
Already, a law firm has filed a search at the Electoral Commission to ascertain whether Dr Zanetor’s name is in the Electoral Register.
Safo & Marfo @ Law wants to know:
“1. Whether or not Dr. Ezanator (Zanetor) Rawlings is a registered voter within the meaning of Article 94 (1)(a) of the 1992 Constitution of the Republic of Ghana.”
“2. If so when was her name entered into the electoral register?”
The law firm also wants a certified true copy of the of the voter’s register.
