Former Ghana Bar Association (GBA) President Yaw Acheampong Boafo has criticised the Constitution Review Committee's (CRC) recommendation to remove the association from the 1992 Constitution, alleging the move is politically motivated by the ruling National Democratic Congress (NDC).
In a recent interview on Good Evening Ghana, Mr Boafo dismissed the recommendation as baseless, noting that none of the constitutional bodies on which the GBA serves have raised complaints about its representation.
The GBA holds seats on the Police Council, Immigration Council, General Legal Council, Judicial Council, and National Media Commission.
“Is there any empirical evidence that GBA representation on those constitutional bodies has not discharged its duties diligently?” Boafo challenged.
He pointed out that even the late President Jerry John Rawlings, despite historical tensions with the GBA, recognized its importance by including it in the Constitution.
Boafo suggested the push for removal stems from partisan interests rather than substantive critique.
“They are articulating a partisan argument, not because it is empirical… Only openly partisan lawyers complained about the GBA, and the CRC conceded that point. I have a problem with that,” he stated.
He expressed concern that the CRC accepted the proposal without justification from the relevant councils, undermining what he sees as the GBA’s vital role in Ghana’s democratic framework.
