The Court of Appeal has in a unanimous decision ruled that The Multimedia Group can broadcast a documentary detailing the pervasive theft of cocoa beans.
The three-member panel presided over by Dennis Adjei held that the application by the licensed Cocoa Buyers Association is unmeritorious.
An Accra High Court in May 2018 gave the media giant the green light to air the documentary.
But lawyers for the Association filed an appeal at the Court of Appeal, asking that the court injuncts the media organisation from airing the documentary. They insist airing of the documentary will cause them irreparable damage.
The Association also filed another application at the Supreme Court seeking to set aside the High Court decision on the basis that the court lacked jurisdiction.
This application was dismissed.
The documentary 'Missing Kilos' is an investigation by Joy News' investigative journalist Kwetey Nartey which was due for broadcast in February 2018.
But running to court, the cocoa buyers said, the documentary "contains unfair and unverified allegations of crime made against the companies".
Their lawyers on Monday urged the Appellate court to grant their request for an injunction.
Lawyers for the media giant represented by Roselyne Kaledzi urged the court to dismiss the case insisting the cocoa buyers had failed to demonstrate that they have a right to be protected.
She said the application forms part of moves to frustrate the airing of the documentary. She said the findings of the documentary are of national interest and should not be blocked.
The court dismissed the injunction describing it as unmeritorious. It also awarded a cost of ¢2,000 against the Association.
