The Council of the Ghana Bar Association says the actions of the deposed president Nii Osah Mills has brought the entire administration of justice into disrepute.
Nii Osah Mills was forced to resign by the council after he alleged on Joy Fm, an Accra based radio station, that the incarcerated boss of the Ghana National Petroleum Corporation (GNPC), Tsatsu Tsikata did not receive a fair trial.
But Mr. Frank Davis, a member of the council said the comment flouted the basic tenets of the law.
He told Joy News’ Evans Mensah the comments by the deposed president were prejudicial.
“When a matter is under judicial consideration and judgement has not been delivered, that matter is not open to discussion by any body, be you a lawyer of 100 years standing or one year standing,” he explained.
"The elicited matters by Nii Osah Mills are the very issues in contention at the appeals court and you don't give your own judgement when the appeal court judges have not," he added.
Mr. Tsatsu Tsikata was jailed for five years by an Accra Fast Track High Court for causing financial loss to the state, but has appealed the decision at a superior court of appeal, which is yet to give its judgement.
Mr. Frank Davis noted that any attempt to seek justice for the embattled boss of (GNPC) can only be done in the competent court of law.
“The only vehicle for defence is the court of law. It does not lie in the unfettered digression of anybody to sit on radio and comment on issues pending in the court of law.”
Mr. Frank Davis vehemently defended the councils decision to demand the resignation of the president, saying, “it is the decision making body of the association. Its decisions are later ratified by the entire members of the bar.”
“If we don’t have that power there will be no need to for a council,” he proclaimed.
Mr. Davis dismissed assertions that the council’s decision was politically motivated, saying: “That does not arise. It is unnecessary.”
On the abortive attempt to elect new executives in the just ended Annual General Meeting, he said the Electoral committee of the association breached the constitution, necessitating an adjournment to November 15.
