Nana Kofi Yirenkyi, aka Jesus One Touch, the founder and General Overseer of Jesus Blood Prophetic Ministry, yesterday told an Accra Circuit Court where he is being tried for allegedly defiling his 10-year-old daughter that he would not open his defense. According to him, he would appeal the decision of the Circuit Court Judge Georgina Mensah-Datsa, which ordered him to open his defense, explaining that he had started filing his appeal and an order for stay of proceedings, pending the outcome of the appeal which would be made available to the court. This was made known by Adomako Acheampong, counsel for the accused person, who also said there were typographical errors in the ruling, and that once the corrections were effected he will quickly file the appeal. ASP Sara Ekua Acquah told the judge that she wanted the accused person to be transferred to prisons custody because it was not safe to keep him in police custody, adding that her life had been threatened by unknown persons in connection with the case. The accused person’s counsel, however, prayed the judge not to make such an order as he would not always have access to his client anytime he wanted. He maintained that the right person to make such a complaint to the court would be the station officer. The judge was of the view that getting access to prisoners at Nsawam was very difficult, but said he could be transferred to any other police station if the prosecutor wanted to. The case has been adjourned to May 24, 2010. Even though the evidence of a medical gyneacologist at the Police Hospital indicated that the penis of Jesus One Touch could not have caused damage to his daughter’s hymen, he has been ordered to open his defense. Dr Amu Mensah, in his evidence, had disagreed with an earlier medical doctor and stated that the damage to the hymen of the 10-year-old daughter could not have been caused through a sexual act. The witness, also an Assistant Commissioner of Police (ACP), said the object that caused damage to the hymen could be the last finger of an adult. According to him, when the victim was examined, the size of the vulva was 10 millimetres; therefore, the object which caused the damage could be the last finger of an adult. He said that even if the damage to the hymen was caused through sex, the size of the penis would be an under-sized one or that of another child. The medical officer told the Circuit Court that in his findings, he observed that the damaged hymen had healed. On the other hand, Dr Bedford Simon Sarfo, also a gyneacologist from Tetteh Quarshie Memorial Hospital, testified that on February 23, 2010, when the victim was brought to him, he examined her and realized that the hymen was broken and it was likely from the result of having sexual intercourse and tendered his report to the court in evidence. However, the trial judge said after listening to the case of the prosecution, she was convinced that “a prima facie evidence had been established against the accused person”, for which he must tell his side of the story. She gave the ruling after Adomako Acheampong, counsel for the accused person, made a submission of ‘no case’ last week, saying that the prosecution had failed to prove that the accused person was indeed guilty of the offense for which he was charged. The accused person reportedly shed tears of joy and hugged his pregnant wife outside the courtroom after Dr Amu Mensah’s evidence which suggested that anything other than a penis could have been responsible for the breakage of the victim’s hymen. Church members who had thronged the court to offer their moral support, jubilated and poured talcum powder on each other as police officers escorted the pastor, who pleaded not guilty to incest and defilement, back to custody. The complainant, Bernice Owiredu, mother of the victim, had told the court that Jesus One touch sought for amicable settlement of the defilement case against him, long before the case was sent to court. According to Madam Owiredu’s evidence, the child informed her sister that her father had sex with her on Saturdays and Sundays when nobody was in the house, as well as on Tuesdays when she did not go to school. She alleged that after every session, her father wiped the sperm with a handkerchief and threatened to beat her with a belt if she told anybody. The victim was sent to Mampong Hospital, where medical reports indicated that she had been defiled and the matter was reported to the police. The defense lawyer had informed the court that they were going to conduct a DNA test on Efo, the houseboy, and the Prophet as well as the child, to ascertain if any of the two men’s sperm had ever entered the 10 year-old child.
