Madina MP Francis-Xavier Sosu has questioned the legality of the Office of the Special Prosecutor’s decision to invite private legal practitioner Martin Kpebu for questioning.
Speaking on Joy News’ PM Express on Wednesday, December 3, he said the move has no legal foundation and must not be entertained.
According to him, the OSP cannot investigate a complainant when the allegation is against the institution itself. He said the invitation simply does not make legal sense.
“It doesn’t make legal sense to me, because in the first place, I don’t know how Martin is under investigation. If I have made an allegation against the OSP, how do I end up being the one to be under investigation in the first place?”
He argued that no institution should be allowed to investigate itself. He said the matter should have been referred to another body.
“How can the OSP even investigate itself? If there’s an allegation against OSP, which is an anti-corruption agency, I’m expecting that an institution like EOCO or some other agency of the state will take up that matter and want to investigate. So the invitation… in the first place is not legally justifiable. There’s no basis for even inviting him in the first place.”
Mr Sosu said the situation became even more troubling when Kpebu was detained. He described it as unlawful and unacceptable.
“To have even detained him, it’s even worse, because, I mean, what will be the basis? Honestly, this is completely unacceptable. It is illegal.”
He insisted that the action by the OSP must be condemned.
“And I think that, as I read, many people condemn already, it must be condemned. This is so wrong, and it must not be accepted.”
