A 28-year-old man who had spent the last 10 years on remand in prison without trial has now been granted bail by the Accra Fast Track High Court.
Kwadwo Enu was a 17-year-old mechanic apprentice in 1999 when he set out one evening, allegedly to satisfy an essential need - to buy food to eat.
That was the move which landed him in trouble and since then Enu has been languishing in jail for more than 10 years without trial until his appearance in court on July 5, this year.
Kwadwo Enu was arrested among a group of people during a swoop by the police around his Laterbiokoshie residence and since then has been in custody at the Nsawam Medium Security Prisons for alleged robbery.
His relatives had been in and out of the Accra High Court because the prosecution had not started the case.
But on July 5, this year, luck smiled on Enu when his counsel, Captain Nkrabeah Effah Dartey's (rtd) application for bail, received a positive response from Judge Justice Charles Quist.
The Judge granted him bail in the sum of GH¢ 10,000 with two sureties and a justification but his problems seemed not to have ended.
A relative, Eric Kwamina Sam, who stood as the surety claims the police had refused to accept an unregistered indenture on a three storey property at Abossey Okai in Accra even though they had gone to inspect the property.
At the court's sitting, Justice Quist drew the attention of the Director of Public Prosecution (DPP) to expedite action for the hearing of the matter.
"Even though robbery is one of the cases for which bail is not allowed, I have been compelled to grant bail in this case because it is one of the longest standing cases in the court", the judge declared.
He, therefore, adjourned the case to August 5, 2010.
Captain Nkrabea Effah Dartey, in his application, prayed the court that since 1999, his client who had a positive prospect for life had, been dumped in custody without any attempt to have the matter heard.
