A man has been sentenced to 12 months in prison for invoking curses on the police.
A Facebook post by Oliver Barker-Varmowor, explaining the facts of the case, revealed that the convict is a driver at Kasoa, who was stopped and searched by the police.
According to the post, the police took his bag and poured the driver’s belongings on the floor during the search. The convict, who was unhappy with the incident told them there was no need to throw his things about.
“Immediately, one of them slapped him from the back and another one slapped him again and they started beating him up, they dragged him on the floor to their car, and through that pain, he pronounced curses on them with three different rivers, and they took him to cells that evening.”
“The next day we heard it and went to the police station at Kasoa to plead on his behalf, but it was to no avail, we came home, and then Tuesday morning I called the CID to ask about my brother and he said they are taking him to court that morning so we should meet him at Kasoa District Court Akweley,” parts of the post read.
However, the driver was allegedly not allowed to communicate with anyone before his case was called.
“The Judge sentenced him to12 months imprison,” the post added.
Meanwhile, the court verdict attached to the post revealed he was charged with offensive conduct contrary to section 207 of the Criminal Offenses Act, Act 29.
Section 207 of Act 29 reads “A person who in a public place or at a public meeting uses threatening, abusive or insulting words or behaviour with intent to provoke a breach of the peace or by which a breach of the peace is likely to be occasioned, commits a misdemeanour.”
The driver, in the court verdict, pleaded guilty stating that his actions were to protect himself.
However, the judge ruled that “the explanation of the accused holds no water and I find him guilty. He claimed that they were five on board but it was only him who was searched and this aroused his anger to invoke the name of the rivers he used to invoke the curse on the complainant, Ahwerewaa, Etwa and Antoa. The demeanour of the accused shows that he has no remorse. Accused is sentenced to 12 months in high labour.”
