New Patriotic Party (NPP) Director of Legal Affairs, Gary Nimako Marfo, has defended Kpandai MP, Matthew Nyindam, for filing at the Supreme Court to quash the High Court’s election annulment.
He insisted that the Kpandai MP has suffered a substantial miscarriage of justice, urging the Supreme Court to intervene and overturn the High Court ruling that nullified his 2024 parliamentary victory.
Speaking on Joy FM’s Top Story on Monday, December 1, Mr Nimako argued that the High Court, Commercial Division, in Tamale, fundamentally erred by assuming jurisdiction over a petition that was filed out of time.
“Matthew Nyindam has suffered a substantial miscarriage of justice before the court, and the Supreme Court must correct this injustice. We are simply saying that at the time the NDC petition was filed, the court ought not to have entertained the matter at all, let alone proceed to hear it and deliver judgement.”
he stated.
This follows Mr Nyindam’s application to the Supreme Court seeking to annul the High Court judgement, which ordered a rerun of the Kpandai parliamentary election.
According to Mr Nimako, the original election petition filed by the NDC did not meet the mandatory 21-day statutory deadline required after the publication of the gazette.
He explained that the petition challenging Mr. Nyindam’s election was filed on January 25, clearly outside the 21-day window, making the entire process void in the NPP’s view.
“We are waiting for the Supreme Court to hear the matter,” he added.
