Four persons have dragged the Electoral Commission (EC) and the Attorney-General to the Fast Track High Court over the creation of new district assemblies and constituencies.The four are claiming that the EC failed to adhere to legal processes before creating the said districts and constituencies and, for that reason, its actions were illegal.According to the four, the respondents also failed to consider issues of fairness during the demarcation of districts for the creation of the new constituencies.Atta Dwomoh, Abdul-Rahman Abubakar, Magarett Senkyire and Wilford Quarcoo, who describe themselves as Concerned Citizens of Ghana (CCG), are praying the court to declare the newly created metropolitan, municipal and district assemblies (MMDAs) and constituencies, null and void.They have consequently filed an interlocutory injunction praying the Fast Track High Court to restrain the EC from going ahead to create new constituencies out of the newly created districts.The application for interlocutory injunction, which was filed on behalf of the four by their lawyer, Mr Frank Davies, could not be moved at the Fast Track High Court sitting in Accra today because the presiding judge was indisposed.It is expected to be moved on July 25, 2012.According to the applicants, the creation of the new districts was in contravention of the provisions of the local government Act 1993, Act 462 and must, therefore, not be entertained by the court.They argued that unless restrained by the court, the respondents would go ahead to create the new constituencies which, according to them, would cause many voters to suffer irreparable loss.
