The Director of the Ghana School of Law (GSL) Mr. Kwaku Ansa Asare as filed a writ at the High Court, Accra in which he is seeking various reliefs against 11 lecturers of that institution in what promises to be a battle of display of knowledge of the law.
Mr. Ansa-Asare is praying for general damages in respect of alleged libel contained in a publication of defamatory words in a petition the 11 Law Lecturers signed and addressed to the Chairman and members of the General Legal Council, and an order for a retraction and an apology of the said petition by the Law Lecturers among others.
The Law School Boss charges that a petition dated February 19, 2007 and addressed to the Chairman and members of the General Legal Council and signed by all the defendants contained language that portray him as a common thief.
The Law Lecturers who are defendants in the suit are Mr. Sam Okudzeto, Justice Sam Baddoo, Mr. Gottftried Nikoi, Mr. Joseph Aryeetey, Mr. Alexander Buabeng and Mr. J.K.E Edzie.
Others are Dr. Kofi Oti Adinkrah, Dr. Kwaku Anyemedu and Mr. Maxwell Opoku-Agyemang. The rest are Mr. Albert Adaare and Mr. Nene Amegatcher.
In respect of Justice Sam Baddo, the Law School Boss's Statement of Claim describes him thus: "though a retired justice of the Supreme Court of Ghana (he) is also a part-time Lecturer in the Ghana School of Law, in clear violation of the Constitution," and prays for a declaration that "... his continued employment by the General Legal Council as a part-time Lecturer in the Ghana School of Law is unlawful, he having attained the compulsory retiring age of 70 as a Justice of the Supreme Court of Ghana."
In the case of Nene Amegatcher, the Law School Boss is praying for a declaration that" ... he is not a Lecturer in the Ghana School of Law either as full-time or part-time and, therefore, that his signing the petition in his capacity as such Lecturer is false."
An accompanying Statement of Claim to the Writ which was filed at 10:30 a.m. on Thursday, April 26, 2007 states that sometime in August 2005 and by a letter addressed to the Plaintiff, the General Legal Council directed the Plaintiff in his capacity as Director of the Ghana School of Law to proceed on leave pending the investigations of allegations of wrong doing against the Plaintiff.
