The National Democratic Party (NDP), will on November 30, 2012, know whether or not its flag bearer, Nana Konadu Agyemang Rawlings, will participate in the December polls as a presidential candidate.This is because the Human Rights Division of the Accra Fast Track High Court has fixed that date to give its judgment in the matter in which the party is fighting to have the name of its flag bearer included on the ballot paper of presidential candidates for the December polls.The party had gone to court to seek an order of review to compel the Electoral Commission (EC) to include the name of its flag bearer on the ballot paper of presidential candidates after the nomination forms of the flag bearer had been rejected by the EC.Lawyers for the parties argued out their cases last Tuesday.Counsel for the party, Mr Raja Stanley Ahorlu, moved the motion relying on documents filed but added that the EC officials were supposed to endorse the nomination forms of the party's flag bearer and stated reasons why they rejected the forms, but that was never done.According to him, since the decision to reject the forms was made by the returning officer of the EC, it was subject to review and that was why the party was in court.He said the EC, by preventing the former First Lady from participation in the polls, had violated her fundamental human right, an obligation that the EC failed to comply with."We are here, therefore, to seek a review of the illegal act of the EC. Our position is that we are citizens of this country. Our right has been enshrined in the law. If anybody wants to take that, it should be by the law”, he said.Mr James Quashie-Idun, counsel for the EC, noted that the forms of the party's flag bearer were submitted late and that there was no way an opportunity could be given to them to complete the forms when there were glaring omissions of signatures, especially from the northern sectors of the country.The NDP, as a party and its flag bearer, Nana Konadu Agyemang Rawlings, instituted the action against the EC and the Attorney-General (A-G).According to the NDP, the decision by the EC to reject Nana Konadu's nomination forms was wrong and inconsistent with the electoral laws and the 1992 Constitution. It said it was also against the flag bearer's fundamental human right as enshrined in the 1992 Constitution.On October 19, 2012, the EC rejected the nomination papers of the former First Lady and flag bearer of the NDP, citing major errors on her forms.Other parties that had their forms rejected were the Independent People's Party (IPP), the New Vision Party (NVP), and the YES People's Party (YPP).The IPP and the NVP are also known to have gone to court to seek redress.The NDP had said it believed that the rejection of its flag bearer's nomination was a calculated attempt by certain individuals who had connived with the EC to collapse the party for it to return to the fold of the National Democratic Congress (NDC), the party from which the NDP emerged.
