The Ghana Bar Association (GBA) was prevailed upon to back down on plans to punish lawyers Tsatsu Tsikata and Gabby Otchere-Darko for violating the Association's code of ethics during the 2012 Presidential election petition.
This was revealed to Joy News by a high level insider.
Mr Tsikata, who was Lead Counsel of the National Democratic Congress during the election petition accused Justice Anim Yeboah, one of the judges hearing the case, of allowing his political bias to cloud his judgment.
The former law Lecturer said Justice Anim-Yeboah consistently took an opposing stance against the NDC’s arguments during the petiton.
He made the remark on Hot Issues, a current affairs programme on TV3 hosted by Kwasi Pratt Jr.
Gabby Asare Otchere-Darko, former Executive Director of the Danquah Institute also described the election petition judgment by the Supreme Court as corrupt.
But the Joy News source says the Supreme Court Judges including those specifically accused of misconduct were not interested in the process citing a potential of further polarization of the country along political lines.
The Judges, according to the source, took the view that the election petition had already polarized the country hence it wouldn't be in the best interest of the country for the GBA to pursue a disciplinary action at the General Legal Council.
The concern of the judges stem from the fact that, by the nature of their alleged acts of misconduct, the two risk the ultimate sanction of being stripped off their licenses to practice in Ghana's law courts, if found guilty.
The two lawyers were recently summoned before the Disciplinary Committee of the General Legal Council over the same matter.
