Former National Democratic Congress (NDC) Member of Parliament for Adentan Constituency has thrown his unflinching support behind lawyer Benony Tony Amekudzi who sought to prevent the Supreme Court from hearing the Presidential Election Petition filed by the New Patriotic Party (NPP).
Lawyer Amekudzi filed amicus curiae (a friend of the court) motion Thursday arguing that a sitting president cannot be sued or be joined to a suit as a respondent in an Election Petition.
His motion was thrown out by the presiding judge after a unanimous objection by Counsel for both petitioners and respondents.
Lawyer Amekuzi has since been subjected to public ridicule with many describing him as a total distraction to the day's proceedings in court.
On the contrary, Kojo Adu-Asare on Asempa FM’s Ekosii Sen programme said the learned lawyer had a legitimate concern.
"This man is making a lot of sense to me; everybody can choose to disagree with me but I want to be the lone ranger who wants this issue thought through once again".
The former Adenta MP intimated that John Mahama did not lose his presidential status when he contested the 2012 general election therefore he cannot be sued.
"John Mahama at no point from 2012 in to 2013 lost his position as president where someone can say he was not the president and so can be sued" he stressed.
According to him, if this trend continues, it will open the flood gate for any aggrieved person to sue a president after an election.
Conceding that lawyer Amekudzi did not follow due process in court, Adu-Asare said it should not have affected the substance of his case.
The NDC man called on all condemning Amekudzi to do an introspection about the future repercussion of the court's decision on the country.
However, Samuel Awuku, NPP Deputy Director of Communication accused government of being the brain behind Amekudzi’s theatrical display in court.
He alleged that the utterances by leading members of the NDC attest to the fact Amekudzi’s presence in court was part of a grand scheme by government to delay the case.
Sammy Awuku said "God is keeping his covenant with the NPP" hence NDC's delay tactics would be an exercise in futility.
