President of the Supreme Court panel that heard the Presidential Election Petition brought proceedings to a dramatic close by paraphrasing Kwame Nkrumah's famous statement, “at long last the battle is over."
After counsel for the parties signaled to the court that they were done with their arguments, Justice William Atuguba, cried, "At long last the battle of evidence is over," to a rapturous applause.
His declaration summed up the hearing of a 46-day Election Petition filed by three Petitioner- New Patriotic Party Presidential candidate Nana Akuffo Addo, his running mate, Dr. Bawumia and NPP chairman Jake Obetsibi Lamptey.
They are praying the court to overturn the declaration of John Mahama of the National Democratic Congress as winner of the 2012 elections. The Election Petition hearing began on 16th April 2013.
It was widely expected that Phillip Addison would end his cross-examination of the witness for the Electoral Commission, Dr. Kwadwo Afari-Gyan and he did paving the way for the closure of legal arguments.
He finished at 5:00pm. Tsatsu Tsikata counsel for NDC also did a three minutes re-examination of the witness.
After this, Atuguba, visibly delighted, announced that the battle of evidence was over. He paraphrased the popular declaration by Ghana’s first President- Kwame Nkrumah when he said on the eve of independence day in March 1957 “At long last the battle has ended. Ghana, your beloved country is free forever”.
Before the laughter died down, he singled out the Chairman of the Electoral Commission, Dr. Afari-Gyan who had stepped out of the witness for mockery.
"When you tell people go to court, go to court, it is not that simple".
This provoked further laughter.
He also announced that the parties were to submit their written addresses by 30 July 2013. The Judges will give a ruling on the Petition after perusing their addresses.
