Baby custody battle takes a new twist

The three month-old baby who is embroiled in a heated lawful custody has taken a new turn as the case has landed in court.

A suit filed by ElizaBelt. Esi Denyo, President of the Ghana Dia­betes Association, is citing Gifty Pobee, Rashida Abdallah and Georgina Agyare as defendants.

The plaintiff is seeking general damages of GHÈ» 2,000,000 against the defendants jointly and severally "for the libel contained in the article head­lined, 'Drama over three-month-old baby' on page 2 of Wednesday, June 18, 2014 edition of DAILY GUIDE."

She is also praying the court for an order to cause the withdrawal of  the said article in its entirety and an unconditional apology by way of a statement approved by the plaintiff.

According to the writ of sum­mons, defendants are to pay for the cost of publishing the said statement to be displayed in the same position as the publication complained of and with equal prominence.

Mrs. Denyo wants damages for unlawful arrest and detention, per­petual injunction to restrain the defendants, their editors, agents or assigns from causing further libelous materials to be published of the plaintiff as well as costs.

In her statement of claim, Mrs. Elizabeth Esi Denyo, who also dou­bles as a lecturer at the Korle-Bu Nurses' Training College, said "the natural and ordinary meaning of the words complained of in the said newspaper meant and were under­stood to mean that Denyo is a crimi­nal, inhumane, a thief and a person who engages in torture."

According to the statement of claim, "by reason of the said publica­tion by the first and second defen­dants, the plaintiff has suffered and continues to suffer great and irrepara­ble damage to her reputation, social and professional standing, as same has reduced her in the estimation of right thinking members of society, her family and friends".

Mrs. Denyo also claims her reputation had been seriously damaged and had suffered considerable distress and embarrassment.
