The trial of four persons arrested at the Kotoka International Airport (KIA) last month for suspected narcotic offences has been discontinued by the Attorney-General (A-G). A source at the A-G’s Department confirmed this to the Daily Graphic on Sunday without any details, except to say that the A-G had filed a nolle prosequi in respect of the matter. The four suspects - Kelvin Boateng, Daniel Gyabaah, Eric Owusu Manu and Frank Bruno Pappoe, were arrested at the KIA about a month ago under suspicion of dealing in narcotics. Their arraignment at the Osu Magistrate Court sparked some controversy, resulting in a reported clash among security operatives, the magistrate and lawyers for the suspects. The Director of the Bureau of National Investigations (BNI) and other officials working under him were later sued for contempt of court following the re-arrest of three of the suspects after they had been granted bail by the Osu Magistrate Court on Thursday. The suspects had spent the night in the custody of the police after a dramatic re-arrest scene on the premises of the Osu Magistrate Court. Agents of the BNI swooped in on them after they had been granted bail, but the magistrate, Ms Ellen Anokye would not have the agents disregard her bail orders without a fight. Three of the suspects, Daniel Gyabaah, Eric Owusu Manu and Frank Bruno Pappoe, had been granted bail last week. Bail was set at GH¢10,000 each and they were to report themselves to the court and the BNI once a week. They were also to submit their passports. Kelvin Boateng was, however, refused bail. The BNI kept the suspects in custody until their lawyers notified the court before being subsequently cleared to go home. But just when they stepped out and joined their counsel in their cars to leave the court precincts, they were intercepted right in front of the courtroom by officers of the BNI. The scuffle that ensued brought the magistrate, Ms Anokye, out to question the rationale behind the action of the security operatives. The BNI operatives, in their efforts to intercept the suspects allegedly drove one of their cars into that of a counsel of the accused, Senanu Ashiagbor, a BMW with registration number GS 312- 10, and dented the bonnet. The judge later ordered the arrest of a driver of the BNI for rude behavior. The Greater Accra Regional Police Commander, Rose Bio Atinga, who led police reinforcement to the court, entered into a meeting with the magistrate, counsel for the accused persons and the BNI. After several minutes behind closed doors, the magistrate disclosed that she had agreed to release the suspects, after consultations with the Chief Justice, to the Accra Regional Police Commander to be under her custody until further notice.
