The NPP has described as illegal the primaries being held across some 45 constituencies in the country by the ruling National Democratic Congress (NDC). The NDC’s action is ahead of the maturation and subsequent passing of the Constitution Instrument 73 which would legalize the newly created controversial constituencies. Apart from this, some private citizens have also challenged the propriety of the creation of the constituencies. So far, the NDC has held primaries in North Dayi, Sagnarigu, Asante Akim Central and Sekyere Afram Plains, Cape Coast North and the Awutu Senya East, Akatsi, and Adaklu constituencies. Joining a panel on Multi TV’s pm:EXRESS to discuss the legality of holding the primaries, Dr. Mathew Opoku Prempeh, NPP MP for Manhyia and also Director of Elections for the biggest opposition party said the action was outright illegal. He contended any act intended to undermine the constitutional democracy of the country must be frowned upon. “Anybody who decides to trample upon our hard won constitution tried and tested for the past eight years is doing this country a great disservice but I am not surprised the NDC will do that”. He argued that under the late professor Mills, a man who was an astute lawyer, “the country has seen all these illegalities and constitutional infringement in all aspects of our lives”. He also raised questions about the EC’s loyalties and credibility especially as it is supervising the NDC’s primaries. Dr. Opoku Prempeh indicated NDC could have waited and done their ground work without necessarily holding the primaries which could lead to legal battles. But George Loh, the lawyer who has unseated North Dayi’s Akua Sena Dansua said the NDC’s action is not illegal. Explaining his party’s reasons for conducting the primaries, he said “NDC wants to be ready when the C.I is passed and not be found wanting or in a rush. You know the CI would have passed already but for the errors”. George Loh revealed his party will take a decision in the unlikely event that the CI does not pass - exposing the confidence of the NDC that the C.I will definitely pass. He promised a keen contest in North Dayi to annihilate the NPP. In the case of NPP, the party’s director of elections says the NPP will always do the right thing and only go ahead to select their candidates when the C.I passes. “NPP will fashion a fair just way for candidates to justify their inclusion during the selection criteria”.
