Power FM’s presenter, Oheneba Boamah Bennie, who was arrested by the Ghana Police Service on December 14 has been released from police custody.
He was arrested at the Police Criminal Investigation Department Headquarters after honouring an invitation by the police to assist in investigations regarding some offensive language and threats he had issued against the President, Akufo-Addo.
He was released at 5:15pm on Wednesday, December 16 when the Police finally bowed to pressure from his Lead Counsel, Lawyer Francis-Xavier Sosu to either send him to court or grant him bail.
According to the Human Rights and Public Interest Lawyer, keeping his client beyond the stipulated 48 hours was a violation of Article 14 of the 1992 Constitution.
He further insisted that keeping the journalist in detention beyond the constitutional requirement also amounted to an abuse of power by the officers of the Ghana Police Service and thus demanded that bail be set for his client.
Lawyer Sosu insisted that the offense in question was a misdemeanor and had to do with an alleged statement which the police already had and did not require any complex investigation.
The Police who were holding the presenter on allegations of offensive conduct conducive for breach of the peace under Sections 207 and 208 of the Criminal and Other Offences Act, 1960, Act 29 admitted him to bail with the sum of 100,000 with two sureties.
He is to report to the Police on December 17, 2020.
