Democratic Youth Forum (DYF) has been monitoring events at the Supreme Court ever since the watertight case was filed by three petitioners of the New Patriotic Party (NPP), on Friday 28th December, 2012, challenging the 2012 elections which declared John Mahama as President.
Before the high profile case was filed at the Supreme Court, the three petitioners led by Nana Akufo Addo had repose confidence in the Supreme Court as the final arbiter to unravel any criminality that sought to undermine the credibility of the December elections and bring to bear, nothing but the truth. However, Ghanaians are desirous to seeing that the case is not only brought to its logical conclusion, but also augment our electoral process in ensuring that subsequent elections in Ghana are irregularities free.
We believe that the Supreme Court once again would earn the needed respect across the globe, if they are seen to be in control of this crucial case.
As a group, we are worried by the fact that the Chief Justice, Her Lordship, Georgina Theodora Wood, has not been present in court ever since the case was filed, but rather appointed her deputy to take over. That notwithstanding, we are particularly concerned about the decision made by the Supreme Court on Thursday,14th March,2013, regarding the directions for the commencement of the case.
We are of the view that the evidence is before the Supreme Court, all necessary parties have joined, and further and better particulars have been submitted by both petitioners and respondents as ordered by the court.
Therefore the Supreme Court must be seen to taking over the commencement of the case, rather than allowing the opposing layers to agree on the directions of the commencement of the case. This could result into an undue delay.
Ghanaians and the international community are aware that this case is going to mark a watershed in our political history and a proof of our understanding of democracy in the African Continent and the world as a whole. For this reason, the Supreme Court judges must sit up and ensure that no stone is left unturned, to unravel the circumstances surrounding the election declaration of the 2012 elections.
Having said that, we are appreciative of the fact that, the Supreme Court judges stood on their feet to throw away the 327 petitioners (marauding octopus) which sought to distort the case in court.
In conclusion, the destinies of Ghanaians are in the hands of our Supreme Court judges to bring justice so that peace would prevail in Ghana.
Therefore the Supreme Court must apply all the rules necessary to ensure that the case commences as soon as possible, even during the Easter season, to speed up the case.
