The legal team for the petitioners in the ongoing election fraud case say lawyer for the National Democratic Congress (NDC), Mr Tsatsu Tsikata, must be held responsible for the perceived slow pace of the trial.
On Monday, the president of the panel of judges hearing the case, Justice William Atuguba, complained about the slow pace of the trial.
Speaking to Joy News a member of the legal team representing the New Patriotic Party (NPP) flagbearer and two other petitioners, Frank Davies, said Mr. Tsikata is stalling the process with his cross examination which has lasted for more than a week.
He stated that "it is not the number of days that a lawyer cross-examines their witness that shows they are doing any good work”.
But the NDC legal team insists they are only taking their time to do a thorough job.
Victor Kojogah Adawudu believes “It’s a case where you have to annul the votes of people. It is their constitutional right so we want to make sure that no vote is annulled just because a presiding officer did not sign a pink sheet or somebody has not done something right”.
According to him, if there was any other option for meticulous scrutiny of the evidence brought by the Petitioners, the Court would have suggested it.
He believes the Court also knows the importance of the cross-examination.
Victor Kojogah Adawudu has also rubbished allegations they have resorted to unnecessary delay tactics to prolong the case.
He says it is in the interest of the government in power, as it is the Petitioners, to have this case dealt with as quickly as possible.
According to him, the government has made promises and must deliver on them because they cannot go back to the electorates four years later and tell them that because of the court case they could not honour those promises.
Cross-examination of the Petitioners’ key witness, Dr Mahamudu Bawumia has been going on for about two weeks with Tsatsu Tsikata, lead Counsel for the third respondent taking eight days so far.
Mr Tsikata continues his cross examination of Dr Bawumia on Tuesday.
