The much expected appearance of members of the Ghana Football Association (GFA) before the Commission of Inquiry into Ghana's participation in Brazil, took a dramatic turn Tuesday, when counsel for the Association's vice president, managed to force a postponement of the hearing for his client.
Thaddeus Sory, argued that, the right of his client Fred Crenstil, chairman of the Black Starlets Management Committee and Vice President of the GFA was violated, because he was not given adequate notice before the hearing.
Sory, said, his client only picked up his invitation Tuesday morning to appear before the commission the same day, when he should have been given a clear eight day notice.
The lawyer also wanted to know, whether his client is “a target or non-target witness” before the Justice Senyo Dzamefe Commission could take his testimony.
The presentation sent the sitting into a legal tussle between members of the commission and lawyer Sory, who insisted on the rights of his clients.
The commission took a short break to deliberate on the matter and on resumption, granted the request of the lawyer.
Justice Dzamefe admitted Sory was right adding “I enjoyed the academic exercise. It was good, lawyer Sory you are intelligent,” he stated.
Justice Dzamefe however, noted that, the Commission could have also insisted to proceed based on its powers to modify the counsel’s request according to Rule 23 of CI 65 but stated that, they will agree to Sory’s request of seeking adequate notice for his client.
The Commission, applied Rule 9 of CI 65 which grants the witness a grace period of eight days to reappear from the day invitation was served.
