An attempt by Dr Sulley Ali-Gabass to seek bail on the grounds of ill-health has been refused, Myjoyonline.com can confirm.
Dr Gabass who is facing two charges of defilement and unnatural carnal knowledge, had on two earlier occasions applied for bail but was turned down by the presiding judge Mrs Rita Agyemang Budu.
When the in-camera hearing resumed Tuesday, the defence counsel attempted to lay another foundation for bail using a claim of sickness but the prosecution opposed insisting the accused looked "fit and strong".
A source told Myjoyonline.com Dr Gabass had no medical condition to warrant an application for bail, a position the judge agreed with.
The defence however continued with their cross-examination of the frail 16-year-old SHS student said to have been infected with HIV.
The cross-examination lasted a little over an hour.
The source claims the cross-examination did not tackle the substance of the case; whether or not Dr Gabass indeed had sex with the minor.
Instead, the defence asked a number questions, including whether or not the alleged victim saw the mother of Dr Gabass when he visited the Alajo residence of the accused person.
The Senior medical officer at the Effia Nkwanta Regional Hospital in Sekondi was arrested late last year for allegedly having sex with the SHS student.
A thorough investigation done by Joy News' Manasseh Azure-Awuni revealed the accused had sex five times with the victim.
Three of the encounters took place in the car of the accused person with the other two in the Alajo residence of the medical doctor.
In an interview with Manasseh, the accused admitted to having sex with the victim but when the case was sent to court, Dr Gabass pleaded not guilty to the charges.
He however insists he is HIV negative.
Cross-examination is however expected to continue on Wednesday.
