The lawyers for actress Rosemond Brown aka Akuapem Poloo, have urged the High Court to set aside the 90-day jail term handed her and rather impose a fine.
They insist the Accra Circuit Court ought to have considered her guilty plea and imposed a fine instead of a custodial sentence.
The actress who pleaded guilty to the charges of publication of obscene materials, engaging in domestic violence namely conduct that in any way undermines another person’s privacy or integrity and engaging in domestic violence namely conduct that in any way detract from another person’s dignity and worth as a human being, was ordered to serve 90 days jail term.
Her lawyers led by Andrew Vortia say as a first time offender, such a custodial sentence is harsh.
He wants the court to set aside the whole sentence imposed by Christiana Cann of the Circuit Court.
The actress was convicted on Friday over naked pictures with her 7-year-old son.
This was after she pleaded guilty for sharing a nude photo on Instagram while celebrating his birthday in June last year.
Handing her judgement, Christina Cann expressed discontentment with the alarming rate with which nudity has become a thing in the country’s social media space as such, the actress is being punished to serve as a disincentive to others.
But her lead counsel has criticised the sentencing.
He has also filed documents requesting that the actress be granted bail by the High Court pending the determination of this appeal.
In these documents, the lawyer contends that the 90-day sentence is too short and that if she is not admitted to bail immediately by the time the appeal is heard and determined, she would have finished serving the sentence.
